Introduction

FlightX LLC (“FlightX”) values your privacy. FlightX complies with the entirety of the General Data Protection Regulation
(GDPR), the Dutch Telecommunications Act, and all other regulations concerning privacy and the personal data
processing. In this document, we outline the type(s) of personal data we gather and how we use, store, and safeguard
your personal data. We will also list the purposes for which your personal data will be used, and the parties with whom
your data will be shared. You will also be provided with the knowledge of how to access, manage and/or delete your
contact preferences and personal information.

What does this Privacy Policy cover?

This Privacy Policy applies to your usage of the “Website” at the URL standby.theflightx.com, the mobile application
“App” under the name StandBy, and all products and services offered by us through said Website and App.

Your Personal Data

In this document, any information or piece thereof which can be used to identify you as an individual person is referred to as your “personal data”.

Consent

StandBy and FlightX will under no circumstances collect, use or disclose your personal data without your prior consent. You are therefore required to agree to this Privacy Policy before you can begin using our Website or App. Upon the disclosure of your personal information to us during the creation of a StandBy account on our Website or App, you grant your consent to the collection, storage and processing of said information as outlined in this Privacy Policy. You can withdraw said consent at any time of your choosing. Based on said consent, StandBy processes the information it obtains from your end. Personal data processing is a necessary requirement for the performance of a contract OR is done based on StandBy’s and FlightX’s legitimate interests, namely the ability to identify you as a user on the platform, where processing is deemed necessary. 

Personal Data We Process

StandBy collects your personal data upon the act of creation or updating of your account to complete StandBy’s online forms for the purposes of: 

  • Granting secure access to StandBy
  • Providing the user with required and relevant information
  • The development of StandBy and security enforcement
  • Payment processing; and
  • Usage of all services provided by StandBy

StandBy compulsorily collects the following personal data:

NOMINATIVE INFORMATION

Your nominative details such as your primary title, first name(s), surname(s), etc. are required for the purposes of identification, communication, and the provision of requested products and services.

IP ADDRESS

Your nominative details such as your primary title, first name(s), surname(s), etc. are required for the purposes of identification, communication, and the provision of requested products and services. 

EMAIL ADDRESS

For communication that is direct, secure, instantaneous, and convenient, we recommend the email mode of communication, especially for the purposes of conveying messages electronically and recovering your forgotten password(s). During account creation, you will be asked to enter your email address in the corresponding online form on the Website or App. 

SOCIAL MEDIA ACCOUNT(S)

On the occasion of a login using a social media account, for the purposes of account verification, user identification, user-directed communication, and secure access to StandBy, we will store your first name(s), last name(s), profile image(s) and social media Unique Identification Number(s).

FULL POSTAL RESIDENTIAL, WORKPLACE AND/OR PRIVATE ADDRESS

We require your residential/workplace/private address(es) for the purposes of booking and rebooking hotels, the delivery of physical items and/or any other travel-related product.

AIRLINE/EMPLOYER

The current airline employer you work for is stored to provide you with open requests that can be answered by you. 

HOME BASE

For accurate user identification and data analytics purposes, your home base will be stored in the StandBy system

You may be asked for additional information if we deem that said information is required for the services we provide you. 

How Your Personal Data is Used

The following are the purposes for which we process and use your personal data: 

  • We make use of your personal details, email address(es), social media handle(s) and/or profile link(s), etc. to notify you of information and updates and to register you as a user of our Website and/or App. We may also send you messages about topics that may seem within your interests. You can opt to unsubscribe from these services at any time if you so choose.
  • In the case of failed identification, you will be asked to provide more details (for e.g., proof of employment by an airline). Such information will be erased directly after successful identification.
  • Data such as your geolocation, IP address(es) and browser language(s) will be used to address you in a language you communicate in and to show content that is personalized to your country of residence.
  • In the event of fraudulent activity, we will divulge your personal data with the victim(s) in order to enable this person to file a police report. We will share no more data than is necessary for the mentioned report, and you will be notified in advance when we are about to share your data for the aforementioned purpose.

Data Storage 

If you are a member of StandBy, your information will be stored in our database so long as you continue to be a member, regardless of whether or not you use the StandBy Website, App and/or services, until you request account deletion.

Your personal information is stored for a reasonable time period, depending on the nature of said information and its intended use, but only up to a maximum of 30 days after your account deletion request.

In all cases, accounts receivable records and invoices featuring personal data are retained for a period of 7 years in keeping with Dutch statutory laws.

Who We Share Your Personal Data With

StandBy and FlightX do not sell, rent or exchange personal data with any third party. 

Third-Party Service Providers

For the purposes of service delivery, we require sharing specific data with external service providers. The sharing of personal data with processors and/or third parties is only performed if necessary for carrying out our services. We share personal data with the following entities:

All processors and third parties have guaranteed compliance with the GDPR. No other third party has access to your personal data. We use third-party services such as payment transaction processors and payment gateways for payments made through our Website and/or App. These third-party service providers are under contractual obligations to abstain from using said data for any other purpose than to facilitate payments. To abide by Dutch tax and corporate laws, payments that are legally required for administrative purposes will be shared with our accounts provider(s). 

Non-Personal Data 

We may share generic, aggregated data with our trusted affiliates, business partners, and advertisers. Such non-personal data will be fully anonymized and mainly used to identify developmental or technical problems with our Website, App, or backend systems. 

How Your Personal Data is Used

To enhance your experience while you use our Website, we may make the use of cookies. Cookies are text files containing character strings which are placed on your device once it visits a website. Upon consecutive visits, cookies allow the StandBy Website to recognize your device and/or browser. Settings related to cookies can be changed in your browser if you no longer want them to be sent to your device. It must be noted that some Website features and/or services may function improperly or only partially without the use of cookies.

You will be entering into an agreement with these websites upon entering your personal data on them, and they will act as the corresponding Merchant of Record (MoR). They are solely responsible for ensuring the data integrity and Privacy Policy implemented on their systems.

Managing Your Data and Your Rights

in accordance with the GDPR, you have the right to request access to, and the correction/deletion of, your personal data and/or the restriction of the processing of your personal data and/or to the objection of the processing of your data based on Article 6 (1) (f) GDPR, as well as the right to data portability.

You can access your personal data by navigating to your account, where you can additionally adjust and/or erase your personal data.
